1. Introduction

At Naltivo we work to give users the best possible experience through our products and services. In some cases, collecting information is necessary to do so.

For that reason, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the "GDPR") on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and with Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce ("LSSI"), RAINDANCE, S.L. informs the user that, as data controller, it will incorporate the personal data provided by users into an automated file.

2. Data controller

RAINDANCE, S.L. (hereinafter "NALTIVO" or the "Company") is the company that operates this website and the controller of the personal data you share with us. General information about the Company:

3. Collection and processing of personal data

The personal data that may be processed through the website and the legal basis for each processing activity are described below.

  • "Contact us" form: to manage this form we process data such as first and last name, email address, phone and the optional message text.
  • Demo request / sign-up: to manage sign-up and the platform trial we process personal data such as first and last name, company, phone, email address and password. Sign-up may also be carried out through providers such as Google, in which case the personal data is processed by them as well.
  • Commercial communications: to manage any commercial communication and/or newsletter subscription about Naltivo's products and services, we process the email address and any other personal data required for that purpose.
  • Customer support: to provide support for any questions about the services we offer, we process data such as the email address and any other information you choose to share via the available chat.
  • Marketing and communications: if you provide your personal data when creating an account or subscribing to our newsletter, we may use it to send you marketing communications about our products, services, promotions or events. You can opt out at any time by following the instructions included in each email.

4. Legal basis for processing

The legal bases for the processing activities described above are:

  • Consent of the data subject: for demo request forms, newsletter sign-ups, processing of job applications, webinar registrations, user support via chat and the processing of optional cookies accepted by the user.
  • Compliance with legal obligations: for fraud prevention, communication with public authorities and third-party claims.

5. Retention of your personal data

We only keep personal data for as long as is necessary for the purposes for which it was collected with your express consent, to meet your needs or to comply with legal obligations.

To determine how long personal data is retained, we use the following criteria:

  • Personal data obtained when contacting Naltivo about a query or request: for as long as is necessary to resolve the query.
  • Personal data obtained on the basis of your consent to receive communications, or because it is required to comply with regulations: until the end of the period for which it is required.

We may retain some of your personal data to comply with legal or regulatory obligations, to manage NALTIVO's rights (for example, to file claims before the courts) or for statistical or historical purposes.

Once the legally mandated retention periods have elapsed, Naltivo will delete your personal data from its systems and records or anonymise it so that you can no longer be identified.

6. Recipients of your data

In some cases, and only when necessary, NALTIVO will share user data with third parties. Data is never sold to third parties. The external service providers NALTIVO relies on to deliver ancillary services for data processing may access such data only in accordance with NALTIVO's instructions and for the sole purpose of correctly performing the contractual relationship between NALTIVO and its providers.

NALTIVO seeks to ensure the security of personal data when it is sent outside the company and ensures that third-party service providers respect confidentiality and have appropriate measures in place to protect personal data. These third parties are obliged to ensure that information is processed in accordance with data privacy regulations. To meet these safeguards, NALTIVO signs data processing agreements with such providers in accordance with Article 28 of the GDPR.

In some cases, the law may require personal data to be disclosed to public bodies or other parties; only what is strictly necessary to comply with such legal obligations will be disclosed.

7. Storage of your personal data

In general, data is stored within the EU. However, if processing your data involves an international transfer outside the European Economic Area (EEA), NALTIVO undertakes to implement the security measures necessary to ensure an adequate level of safeguarding through data processing contracts and, where applicable, will ensure that an adequate level of protection is offered, whether because the providers have Binding Corporate Rules (BCRs) or because we have signed the European Commission's standard contractual clauses. 8. Your rights and how to exercise them

You can direct your communications and exercise your rights by sending a request to: dpo@raindance.es.

Under the GDPR you can request:

  • Right of access: you can ask for information about the personal data we hold about you.
  • Right to rectification: you can notify us of any changes to your personal data.
  • Right to erasure and to be forgotten: you can request that your personal data be blocked prior to its deletion.
  • Right to restriction of processing: you can restrict the processing of your personal data.
  • Right to data portability: in certain cases, you can request a copy of your personal data in a structured, commonly used and machine-readable format for transmission to another data controller.
  • Right to object and to automated individual decision-making: you can request that no decisions be taken based solely on automated processing, including profiling, that produce legal effects or significantly affect you.

In some cases, the request may be denied if you ask us to delete data that is required to comply with legal obligations. If you have a complaint about how we process your data, you can also lodge a complaint with the competent data protection authority (Spanish Data Protection Agency, "AEPD").

9. Accuracy of the information provided

The user is solely responsible for the truthfulness and accuracy of the data they provide and releases NALTIVO from any liability in that regard. Users guarantee and are responsible for the accuracy, currency and authenticity of the personal data they provide, and undertake to keep it duly up to date. The user agrees to provide complete and correct information in the registration or subscription form. NALTIVO reserves the right to terminate the services contracted with users if the data provided is false, incomplete, inaccurate or out of date.

NALTIVO is not responsible for the accuracy of any information that is not produced by NALTIVO and for which a different source is indicated, and therefore assumes no liability for any potential harm caused by the use of such information.

NALTIVO reserves the right to update, modify or delete the information contained on its websites, and may even limit or restrict access to such information.

10. Security measures applied to protect your personal data

NALTIVO has adopted the levels of security legally required for the protection of personal data and seeks to put in place additional technical means and measures within its reach to prevent the loss, misuse, alteration, unauthorised access and theft of personal data provided to NALTIVO.

NALTIVO is not responsible for any harm that may arise from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system, when caused by reasons beyond NALTIVO's control, nor for delays or blocks in the use of this electronic system caused by deficiencies or overloads on telephone lines or the data centre, the internet or other electronic systems, or for damage caused by third parties through unlawful intrusions beyond NALTIVO's control. Nevertheless, the user should be aware that security measures on the internet are not impenetrable.

In particular, the site is secured with a TLS certificate using RSA encryption, which means that all information sent to the site is encrypted using the HTTPS protocol.

This privacy policy may be amended. We recommend reviewing it periodically.
